Terms of service

The short version: Hearthwise is an educational budgeting tool for families. An adult parent or guardian sets it up, uses it for their own family's budgeting, and keeps kids on their side of the app. It isn't financial advice. Everything else below is the formal version of that.
1. Who we are
Hearthwise is provided by the Hearthwise team ("we," "us," or "our"). These terms are an agreement between you and us. By downloading or using Hearthwise, or by joining the waitlist, you agree to them.
2. What Hearthwise is
Hearthwise is an educational budgeting tool that helps families plan spending, run a weekly money meeting, and teach kids about money. It is not a bank, lender, or financial institution, and nothing in the app is financial, investment, tax, or legal advice. Kids' jar balances and Kindling (formerly "Family Bank") are amounts you choose to track for your own children. They are not a deposit account, and no money moves through the app. Always do your own research or consult a qualified professional before making financial decisions.
3. Who can use Hearthwise
You must be at least 18 years old (or the age of legal majority where you live) and a parent or legal guardian to set up and manage Hearthwise. Children may use Hearthwise only through a kid profile that a parent or guardian creates and supervises. The waitlist is also for adults only.
4. Your license to use Hearthwise
We grant you a personal, non-transferable, revocable license to use Hearthwise for your family's own budgeting on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing). You may not copy, redistribute, resell, reverse-engineer, or attempt to extract the app's source code, except as permitted by law.
5. Your responsibilities
- Accuracy. You're responsible for the information you enter. Hearthwise calculates based on what you provide.
- Your parent PIN. Keep your parent PIN private. Every family sets one up, and it's a family lock for everyday hand-offs. Resetting it requires Face ID or Touch ID on devices that have it, or the device passcode on devices that don't. If neither is available, the PIN can't be reset until one is turned on. On a device without Face ID or Touch ID, anyone who knows your device passcode could reset it.
- Kids' profiles. Kids' profiles are created and managed by a parent or guardian. You confirm you have the right to enter information about your children.
- Your device and backups. Your family's data lives on your device (see our privacy policy). Backup files you export are encrypted with a recovery code shown to you once. Keeping your device, your backup files, and your recovery codes safe is up to you; we can't recover a backup if its code is lost.
6. Acceptable use
Don't misuse Hearthwise. That means no attempting to disrupt the app, no uploading unlawful content, and no using the app for anything illegal.
7. The waitlist
If you join the Hearthwise waitlist, we'll use your email address to send launch updates and product news, as described in our privacy policy. You can unsubscribe at any time.
8. Payments
Hearthwise is currently free. If we introduce paid plans in the future, pricing, billing, and refund terms will be presented clearly before you purchase anything. Purchases made through the App Store are processed by Apple under Apple's terms.
9. No warranties
Hearthwise is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We don't guarantee the app will be error-free or uninterrupted, though we'll do our best to fix problems quickly.
10. Limitation of liability
To the maximum extent permitted by law, Hearthwise and its owners are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim (which is currently $0). Some places don't allow these limits, so they may not apply to you.
11. Apple App Store terms
If you downloaded Hearthwise from Apple's App Store, the following also applies:
- Agreement between you and us. These terms are between you and us only, not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for Hearthwise and its content.
- Scope of license. Your license to use Hearthwise is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. We are solely responsible for providing any maintenance and support for Hearthwise. Apple has no obligation whatsoever to provide any maintenance or support services for the app.
- Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Hearthwise fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are our responsibility to the extent they aren't effectively disclaimed.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Hearthwise or your possession and use of it, including (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims. If a third party claims that Hearthwise or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints, or claims about Hearthwise should be directed to us at hello@hearthwiseapp.com.
- Third-party terms. You must comply with any applicable third-party terms (for example, your wireless data service agreement) when using Hearthwise.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
12. Changes to Hearthwise and these terms
We may update the app and these terms from time to time. If we make a material change, we'll explain it in the app or by email before it takes effect, and update the "Last updated" date above. Continuing to use Hearthwise after changes take effect means you accept the updated terms.
13. Termination
You can stop using Hearthwise at any time by deleting the app. We may suspend or end your access if you materially violate these terms.
14. Governing law and where disputes are resolved
These terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising from these terms or Hearthwise will be resolved exclusively in the state or federal courts located in Utah, and you and we consent to the jurisdiction of those courts. Nothing in these terms limits any rights you have under the consumer protection laws of the place where you live.
